No matter which Alberta collection agency you choose, make sure they are licensed in the Province of Alberta. In Alberta or AB it doesn't matter if it is a consumer or commercial debt. In order for a 3rd party to collect your debt in AB they must be a lawyer or a licensed under the Alberta Fair Trading Act as an Alberta Collection Agency.

Numerous collection agencies will claim they can legally collect commercial debt in Alberta when in reality they are just hoping they don't get caught. Should they do get caught you the client could face possible liabilities for the illegal actions of your unlicensed collection agency.

Using an unlicensed collection agency in Alberta that isn't licensed is playing roulette with your reputation and there are numerous pitfalls such as:
  1. It is illegal for an Alberta collection agency to carry on business using any name other than the name under which it holds an Alberta collection agency license. A collector employed by a collection agency who claims to be calling from somewhere other than a collection agency is breaking the law. This includes a collector calling under the guise of a law firm, a creditor or some government agency.

  2. In the Province of Alberta collector cannot make more than three unsolicited telephone contacts with a debtor on behalf of the same creditor in a 7 day period. A telephone contact is defined as a telephone call from a collector, an automated telephone call, or a voice mail message.

  1. In Alberta a collector is only permitted to contact a debtor's employer for the sole purpose of confirming the debtor's employment status, title and business address as part of preparing a legal action.

There are other mine fields but the 3 above are probably the easiest ways to generate a complaint. Sooner or later an unlicensed collection agency generates a complaint or query and you are no longer dealing with a debtor but a Large Government regulatory body who wants to know why you have an agency that isn't licensed, collecting debt in Alberta.
