The limit for BC Small Claims Court is $25,000 and creditors can abandon a portion of their debt to fall under this limit. The next consideration in BC Small Claims Court is where you file the claim. for BC Small Claims Court rules state you have to file the claim where the defendant lives or carries on business or where the event that lead to your claim arising.

  1. Notice of Claim prepared and filed in BC Small Claims Court
  2. Debtor Served
  3. Creditor may issue a Pre-Judgment Garnishee against a bank or receivables of a debtor. Funds are paid into for BC Small Claims Court if available.
  4. Debtor responds

    1. Disputed – Referred for Settlement Conference
    2. Admits liability and offers payments

      1. Client Accepts Offer and Payment Order is issued
      2. Client Declines Offer and Sets Payment Hearing
  5. Debtor does not respond

    1. Default Judgment Requested

The BC Small Claims Court is a bit of a chore for a creditor because the Law Society has prohibited agencies from assisting their clients. According to the for BC Small Claims Court it is considered practicing law. Lawyers try to limit themselves to the amount of involvement with a file since their fees could exceed the balance of the account. On the other hand, due to the time involved in a case, clients are reluctant to sue because of the time they could spend in BC Small Claims Court.

The BC Small Claim Courts charge for all their services, but these are recoverable. Service fees are recoverable and lawyer fees are not in BC Small Claims Court. Sheriff Services can be used for service of all BC Small Claims Court documents, which are reasonable for the most part. Private Process Services are quicker and do charge more.

These are the BC Small Claim Court Fees



1. For filing a BC Small Claims Court notice of claim
a) for claims up to and including $3,000$100
b) for claims over $3,000$156
2. For filing a reply, unless the defendant has agreed to pay all of the claim
a) for claims up to and including $3,000$26

3. For filing a counterclaim or a revised reply containing a new counterclaim
